New Resources on CourtADR.org

RSI Launches State-by-State Guide to Court ADR

The RSI team is excited to announce the launch of Court ADR Across the US, a comprehensive national guide to court alternative dispute resolution, on CourtADR.org, RSI’s national court ADR resource center. The searchable guide features court rules, statutes, studies and other resources for all 50 states and Washington, DC, organized in an easy-to-access format.

Important facts about this new service:

1.  It provides a state-by-state view of state and federal court ADR.

2.  It is searchable across states.

3.  It is comprehensive.

Court ADR Across the US is a unique free service, as is the host site CourtADR.org. It is the only resource dedicated to collecting and making available as much information about court ADR as is available. (more…)

Learning from the Gamble on Foreclosure Mediation in Nevada

An article in Sunday’s New York Times purported to examine Nevada’s foreclosure mediation program, especially its shortcomings. The article, combined with a reading of the court rules for the program, points out continuing misunderstandings about mediation, such as what mediators do, the purpose of mediation, and how mediation functions. It also points up a glaring deficiency in many court mediation programs: not tracking the actual results of mediations. In this case, if people are really staying in their homes or moving, if temporary mortgage modifications are becoming permanent, if the foreclosure process is moving more quickly, etc.

In terms of what mediators do, the local rules indicate confusion about the actual role of the mediator. (more…)

CRQ Wants You

Ever thought about writing for publication? In the ADR field, I think of writing and reading articles as an integral part of our conversation about how to improve what we do. I know I am especially interested in new, reliable information about what is happening in court ADR. If you have learned something useful about court ADR, I urge you to share it with others.

It seems like there are more journals related to ADR all the time, but one that remains open to anyone in the field is Conflict Resolution Quarterly. (Disclosure: I am on the CRQ Editorial Board.) CRQ is always open to reviewing submissions. (more…)
