New Report Shows US Federal Courts Embrace ADR

The US Courts’ news service posted last week about a preliminary report by Donna Stienstra at the Federal Judicial Center that shows the extent to which federal courts use ADR. Thirty years after a handful of courts first began experimenting with ADR, every federal district court now authorizes some form of ADR, and a third of courts authorize multiple ADR processes. During the year ending June 30, 2011, more than 28,000 cases were referred to ADR in 49 district courts (out of 94 total district courts; statistics weren’t available for the remaining courts). New RSI Report on Foreclosure Mediations Conducted Per Month

RSI’s foreclosure mediation expert, Heather Scheiwe Kulp, put together a report on the number of mediations being conducted by court foreclosure mediation programs around the country. She calculated these numbers using all the public statistics she could find on the programs. (more…)

Getting the Data Right

“There are three kinds of lies: lies, damned lies, and statistics.” A couple of posts on the American Evaluation Association’s blog Genuine Evaluation have had me thinking about that quote and what it means for the development of court ADR programs.

The quote, of course, refers to the twisting of data to fit one’s argument. Sometimes, though, data is twisted inadvertently, leading to a misinterpretation of outcomes. I recently came across a minor example of this in an AP article that is unfortunately no longer available online,  about the first six months of the Foreclosure Mediation Program in Nevada (“Nevada Court: Homeowners Use Foreclosure Mediation Program,” January 19, 2010).  (more…)
